General Terms

These terms and conditions ("Terms", "Agreement") are an agreement between Livfitty ("Mobile Application Developer", "us", "we" or "our") and you ("User", "you" or "your"). This Agreement sets forth the general terms and conditions of your use of Livfitty's mobile application and any of its products or services (collectively, "Mobile Application" or "Services").

 

Accounts and membership

If you create an account in the Mobile Application, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. We may monitor and review new accounts before you may sign in and use our Services. Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration.

 

No Refunds

In the event that this Agreement expires or is terminated, no portion of any payments of any kind whatsoever previously provided hereunder shall be owed or be repayable or refunded to the user.

 

Service

The content of the Livfitty Website/App/Social Media, including without limitation, text, copy, audio, video, photographs, illustrations, graphics and other visuals, is for informational purposes only and does not constitute or substitute professional medical advice, diagnosis, treatment or recommendations of any kind.

You should always seek the advice of your qualified healthcare professionals with any questions or concerns you may have regarding your individual needs and any medical conditions. You agree that you will not under any circumstances disregard any professional medical advice or delay in seeking such advice in reliance on any content provided on or through the Website/App/Social Media. Reliance on any such content is solely at your own risk.

Results may vary based on each member's physical health, diet and exercise, and adherence to Livfitty's programmes. Livfitty claims no guarantee of results.

If you have not been physically active for more than 1 (one) year, or if you have any medical history that may put you at risk, you are required to seek approval from a qualified health care practitioner prior to using the Services.

 

Backups

We are not responsible for Content residing in the Mobile Application. In no event shall we be held liable for any loss of any Content. It is your sole responsibility to maintain appropriate backup of your Content. Notwithstanding the foregoing, on some occasions and in certain circumstances, with absolutely no obligation, we may be able to restore some or all of your data that has been deleted as of a certain date and time when we may have backed up data for our own purposes. We make no guarantee that the data you need will be available.

 

Links to other mobile applications

Although this Mobile Application may link to other mobile applications/websites, we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked mobile application/websites, unless specifically stated herein. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any businesses or individuals or the content of their mobile applications. We do not assume any responsibility or liability for the actions, products, services, and content of any other third-parties. You should carefully review the legal statements and other conditions of use of any mobile application which you access through a link from this Mobile Application. Your linking to any other off-site mobile applications is at your own risk.

 

Prohibited uses

You are prohibited from using the Mobile Application or its Content for any unlawful purpose, to infringe intellectual property, harass, abuse, spread malware, submit false information, or otherwise misuse the Services. We reserve the right to terminate your use of the Service for violating any prohibited uses.

 

Intellectual property rights

This Agreement does not transfer to you any intellectual property owned by Livfitty or third-parties. All rights, titles, and interests in such property remain with Livfitty. All trademarks, service marks, graphics and logos used in connection with our Mobile Application or Services are the property of Livfitty or third-party licensors.

 

Limitation of liability

To the fullest extent permitted by law, Livfitty will not be liable for indirect, incidental, special, or consequential damages including lost profits, data, or goodwill. The maximum liability shall be limited to the amount paid by you in the month prior to the claim.

 

Indemnification

You agree to indemnify and hold Livfitty and its affiliates, directors, officers, employees, and agents harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys' fees, incurred in connection with or arising from your Content, your use of the Services, or your misconduct.

 

Dispute resolution

This Agreement is governed by the laws of Chandigarh, India. You agree to submit to the jurisdiction of courts in Chandigarh, India for all disputes arising under this Agreement.

 

Changes and amendments

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on Livfitty's website or app. Continued use of the Services constitutes acceptance of revised Terms.

 

Acceptance of these terms

By using the Mobile Application or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

 

Communication

By using our website and mobile application, you consent to receive communications from us via email, phone calls, SMS, and WhatsApp, in relation to your transactions, service usage, and customer support.

 

To access certain features and services such as warranty registration, free diet plans, and additional app-based services, you may be required to register and or log in using a valid mobile number and email address.

 

These contact details may be used for the following purposes:

 

• Account creation, verification, and login
• Order, warranty, and service related updates
• Diet plan access and support
• Customer feedback and service improvement calls
• Important notifications regarding your account or our services

 

We may also use your contact details to send you service updates, feature changes, and system notifications to ensure a better experience.

 

You may opt out of promotional communications at any time. However, transactional, service related, and compliance messages will continue to be sent, as they are necessary for the operation of our services.

 

Terms and Conditions for Livfitty Live Sessions and Livfitty Devices

 

No Recording Policy

Livfitty does not record any Live Sessions. Clients are strictly prohibited from recording, distributing, or broadcasting any part of the Live Sessions without prior written consent from Livfitty.

 

Privacy and Interaction with Coaches

Clients may not harass or make inappropriate comments towards coaches during or outside the Live Sessions. Direct communication with coaches outside Livfitty platforms is strictly prohibited.

 

Health and Safety

By participating in Live Sessions, you acknowledge that you are in good health and capable of performing exercises. Livfitty is not responsible for injuries or health issues arising from participation. Ensure you have a safe environment for exercises.

 

Disclaimer of Liability

Livfitty provides Live Sessions and Devices on an "as is" basis. We make no warranties and are not liable for damages arising from participation or device use.

 

Consent to Data Recording and Usage

By using Livfitty Devices, you consent to collection and use of health-related data (e.g., weight, BMI). Livfitty may use this data to provide diet and wellness plans.

 

Privacy and Data Security

Livfitty will take reasonable measures to protect your data. However, we cannot guarantee absolute security for data transmitted or stored electronically.

 

User Responsibility

You are responsible for proper use of Devices and for discontinuing use if malfunctions or discomfort occur. Livfitty may deny access if risks are identified.

 

User Conduct

You agree to behave respectfully during Live Sessions. Abusive or inappropriate behavior may result in termination of access without refund.

 

Changes to Terms

Livfitty may modify these Terms at any time. Updates will be posted on the Livfitty website/app. Continued use indicates acceptance.

 

Termination

Livfitty reserves the right to terminate or suspend your access to Live Sessions at any time for violation of these Terms.

 

Future Products

These Terms also apply to any future Livfitty products that record personal data, including smart rings or other health monitoring devices.
